For End Consumers: When you call a pizzeria using our AI phone agents, Pizzaboys AI acts as a service provider processing your information on behalf of the pizzeria. The pizzeria is the business (or "data controller") that determines how your information is used, and we process it according to their instructions and our contractual obligations.

For Business Clients: When pizzeria owners interact with our website or use our Service, Pizzaboys AI is the business responsible for your information.

2. Call Recording Notice

All calls to pizzerias using our AI phone agents are recorded. At the beginning of each call, you will hear an automated announcement informing you that the call may be recorded for quality assurance, training, and operational purposes. By continuing the call after this announcement, you consent to the recording.

If you do not wish to be recorded, please disconnect the call immediately upon hearing the recording notice and contact the pizzeria through an alternative method.

We comply with federal and state wiretapping and call recording laws, including two-party consent requirements in states such as California, Connecticut, Florida, Illinois, Maryland, Massachusetts, Montana, New Hampshire, Pennsylvania, and Washington.

4. Text Message Consent and Opt-In

Before sending any text messages to end consumers, our AI phone agent will ask for explicit verbal consent during the phone call. By providing your phone number and agreeing to receive texts, you consent to receive payment links for completing your order and order status and delivery updates.

You will not receive marketing messages or promotional content. Text messages are sent solely for transactional purposes related to your specific order.

Opt-Out: You may opt out of text messages at any time by replying STOP to any message. Message and data rates may apply. For help, reply HELP or contact the pizzeria directly.

5. How We Share Your Information

We do not sell your personal information. We do not sell personal information as defined by applicable privacy laws, and we do not share personal information for cross-context behavioral advertising.

5.1 Service Providers

We work with third-party service providers who assist in operating our Service, including: Stripe (payment processing), Twilio (phone and SMS), Supabase (database), Vercel (hosting), ElevenLabs (AI voice), Deepgram (transcription), and Railway (infrastructure). All are contractually obligated to protect your information.

Payment security: Full payment card details are processed directly by Stripe and are never accessible to Pizzaboys AI or the pizzeria. Pizzerias only receive payment confirmation details and tokenized references.

5.2 Pizzeria Clients

End consumer information (call recordings, transcripts, order details, and payment transaction confirmations) is shared with the pizzeria you contacted, as we process this information on their behalf.

5.3 Legal Requirements

We may disclose information if required by valid legal processes (subpoenas, court orders, warrants), requests from government authorities, or situations involving potential threats to public safety.

5.4 Business Transfers

If Pizzaboys AI is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such change in ownership or control.

6. Data Security and Payment Processing

We implement industry-standard security measures to protect your information. All payment transactions are processed through Stripe, a PCI DSS Level 1 certified payment processor. Payment card numbers are transmitted directly to Stripe and are never stored on our servers. All payment data is encrypted in transit using TLS/SSL encryption.

7. Data Retention

We retain your information for as long as necessary to provide our Service and comply with legal obligations. Call recordings and transcripts are retained for quality assurance and training purposes as long as the pizzeria remains a client, and for a reasonable period thereafter. Payment information is managed by Stripe according to their data retention policies.
